Am I still within the time limit to claim?
Short answerIn England and Wales you usually have three years to issue court proceedings, counted from the date of the negligence or, if later, the date you first knew you had been harmed by it (your date of knowledge). For children the three years start at 18, and no time runs while a person lacks mental capacity.
This checker applies the Limitation Act 1980 (s.11 and s.14), which covers England and Wales. Northern Ireland has equivalent rules under the Limitation (Northern Ireland) Order 1989. Scotland also uses a three-year period under the Prescription and Limitation (Scotland) Act 1973, but for children it runs from their 16th birthday, so results for Scottish claims may differ.
